A fugitive who staged a successful escape from prison for a period of nine years was sentenced to serve a 7-year jail term.
Safari Shariff Pombe, who had been charged with breaking into a shop, had escaped prison and evading an original 7-year term that had been scheduled to lapse by 2021.
At the time, the Senior Resident Magistrate Richard Ondenyo had found him guilty of committing a felony after breaking into the shop.
“A fugitive in Mombasa who escaped justice 9 years ago will now face a fresh 7-year jail term handed down to him in 2014.
“Safari Shariff Pombe had escaped shortly after being convicted for shop breaking and committing a felony,” read a statement by the Office of the Director of Public Prosecutions (ODPP), which was prosecuting the case.
In the latest ruling, Senior Resident Magistrate Rita Orora directed the accused to serve the 7-year jail term as earlier directed.
“Pombe had been convicted by the then Mombasa SRM Hon. Richard Ondenyo. Sitting SRM Hon. Rita Orora ordered that the accused immediately start serving the 7-year jail term which he would have finished in 2021,” added the statement.
The ruling came after another Police Constable was charged afresh at a Mombasa court after he was accused by a civilian in 2018 in Mwenza Village, Likoni.
A co-accused in the case agreed to testify against the officer after the Independent Policing Oversight Authority (IPOA) filed a suit opposing his release on bail.
IPOA accused him of another murder of a boda boda rider he allegedly committed in May 2022.
The accused, however, pleaded not guilty to the fresh charges and is awaiting a judgment scheduled for March 2023.
He is remanded at Shimo la Tewa Maximum Prison.
