Her father, Dida Jaldesa chairs the county’s boundary and dispute resolution committee which put out a legal notice establishing the county as an adjudication area.
The committee has stated that the adjudication be done only in townships and settled areas.
Jaldesa, on the other hand, wants the notice revoked citing some procedures that did not align to the Community Land Act.
Due to her opposition to her father’s directive, there have been discussions online with some users arguing that her stance would attract curses from her father.
The legislator has maintained that she is unbowed by the cultural beliefs stating that she puts her service to the people ahead of family ties.
“If disagreeing with my father will bring me a curse, I do not mind taking it,” she stated during her thanksgiving party in Game, Burat ward.
She was further quoted by The Nation, “If that is the case, I choose the curse as the electorates whom I am indebted to are my parents. I am ready to take the curse to the grave for the sake of my people and I do not want any forgiveness from God (for my stand).”
Jaldesa further stated that the notice would render most of them homeless as the most residents of Burat were already facing eviction by Military barracks despite settling in the area for decades.
“As their elected leader I will continue to champion for their rights and ensure the revocation of the illegal adjudication order. I reiterate the need to register the community land before commencement of the adjudication exercise,” she stated.
Land Adjudication is the process of final and authoritative determination of the existing rights and claims of people to land.
In Kenya, the Land Adjudication Act provides that there should involve determining and recording of rights and interests of individuals residing on registered Community Land for the purpose of facilitating the registration of titles.
