  • Nyeri Governor Mutahi Kahiga and Mathira Member of Parliament Rigathi Gachagua filed applications to stop summons in an inquest into Governor Wahome Gakuru’s death.

    The duo moved to the High Court, challenging a decision to summon them as witnesses in the inquest and they sought a review of the ruling issued by Chief Magistrate Francis Andayi on January 20, 2022.

    In their application seeking a review of the summonses, governor Kahiga and MP Gachagua told Justice Muchemi that none of the witnesses presented during the inquest have mentioned them.

    They also argued that public perception about them would be eroded and their constitutional rights violated.

    Governor Mutahi Kahiga and MP Gachagua also stated that they don’t have evidence to give before the court regarding the circumstances surrounding the car crash.

    According to court documents, the duo stated that they found out about the crash when everyone else heard about it.

    Notably, Gakuru’s family had filed an application in court seeking to have Governor Kahiga explain a statement he made after the crash.

    During a requiem mass for the late governor held in November 2017, governor Kahiga stated that he had warned Gakuru not to use his Mercedes Benz due to its mechanical state.

    The court also heard that Gachagua was a person of interest in the case as a witness in a matter the county was investigating.

    Lawyer Martha Waweru, who is representing Gakuru’s family, in court documents, stated that the late governor had started investigating a case of misappropriation of public funds during the tenure of Nyeri’s first governor, Nderitu Gachagua, who was a brother of the MP.

    “Your honour, it’s good if the Governor appears in court, he made this remark in public at Kimathi University, and as such let him shed light on it,” she submitted.

    Justice Weddy Kagendo had summoned the current Nyeri Governor, MP Gachagua, County Secretary Benjamin Gachichio, and county Chief of Staff Paul Wambugu to appear and shed light on grey areas in regard to Gakuru’s death.
