Requirements for Aspirants to be Cleared by IEBC

  • Aspirants seeking elective posts in the August 9 General Election have to meet requirements set by the Independent Electoral and Boundaries Commission (IEBC), failure to which they will not be cleared to vie.

    The requirements act as a checklist for both the electoral agency and the aspirants. With over 50 requirements tabulated by IEBC led by Wafula Wanyonyi Chebukati, aspirants are racing against time to meet them.

    Here is list of requirements for aspirants:

    Those Nominated by political parties

    If a candidate was a public officer, resignation from office was set for February 9 according to Elections Act 2011.

    A candidate must present the identification document used to register as a voter according to Election (General) Regulations 2012.

    The candidate must be a registered voter at the time of occurrence of the vacancy which is in line with the Elections Act 2011.

    Names in ID and nomination papers must appear as they appear in the voters’ register according to Election (General) Regulations  2012.

    The candidate must be nominated in accordance with the party constitution and rules certified by the Registrar of Political Parties as stipulated in the Elections Act 2011.

    Candidate must submit political party nomination certificate signed by authorized nominating political party signatory whose signature was presented to IEBC in accordance with Elections Act 2011.

    The candidate must be nominated in accordance with the party constitution and rules certified by the Registrar of Political parties in line with Election (General) Regulations  2012.

    Must submit party nomination certificate signed by authorised nominating political party signatory whose signature was submitted to IEBC as contained in the Election (General) Regulations 2012.

    Nomination paper must be signed by the proposer and seconder. Both the proposer and seconder must be registered voter in the electoral area according to Election (General) Regulations 2012. They both must be members of the nominating political party.

    Statutory declaration must be duly signed. Duly filled leadership and integrity self-declaration form according to Leadership and Integrity Act 2012 First Schedule.

    The candidate must present a duly filled Electoral Code of Conduct form in accordance with the Elections Act 2011.

    The presidential candidate should have submitted at least five days to the day fixed for nomination, and deliver to the Commission, a list bearing the names, respective signatures, identity card or passport numbers and voters’ numbers of at least two thousand voters registered in each of a majority of the counties and are members of the nominating party.

    Requirements for Independent Candidates

    Candidate must provide a list of required supporters verified by the Commission as registered in the electoral area for qualification to vie (5 days to nomination day) according to Elections Act 2011.

    Must present a list of 1,000 supporters with each supporter’s copy of ID in the Constituency for Members of National Assembly according to Election (General) Regulations  2012.

    They must present a list of 500 supporters with each supporter’s copy of ID in the MCA race according to Election (General) Regulations 2012.

    Gubernatorial candidates must present 500 supporters with each supporter’s copy of ID in accordance with Election (General) Regulations 2012.

    Candidates seeking Senate seats as independent candidates must present 2,000 supporters with each supporter’s copy of ID.

    For Woman Representatives, 1,000 supporters with each supporter’s copy of ID must be presented.

    Candidates must submit certification from ORPP that he/she has not been a member of a political party at least three months before the date of election according to Election (General) Regulations  2012.

    They must present a copy of Form 11N – Intention to Contest as an independent candidate and a copy of Form 11P – Submission of particulars and symbols by an independent candidate according to Election (General) Regulations  2012.

    Candidate symbol approved by IEBC symbol, identification document used to register as a voter and must be a registered voter.

    Their names on ID  and nomination paper must appear as they appear in voters’ register according to Election (General) Regulations 2012.

    Candidate must submit a symbol to the Commission and it’s approved. Candidate must provide a physical address in the electoral area for purposes of service of documents.

    Nomination paper must be signed by proposer and seconder. They must obtain clearance from Registrar of Political Parties that proposer and seconder present certification from ORPP that each is not a member of a political party.

    Other requirements include leadership And Integrity Self-Declaration Form and Elections Code of Conduct second according to Elections Act 2011 Schedule Elections Act 2011.
