Raila Legal Team Gives Update on Election Petition

  • Former Attorney General Amos Wako confirmed that the petition by Azimio flag-bearer Raila Odinga challenging president-elect William Ruto’s victory in the August 9 General Election is complete and ready for filing.

    Speaking on Sunday, August 21, Wako, revealed that he was part of Raila’s legal team, stating that the coalition’s lawyers shared the document with him and Senior Counsel James Orengo for a final read before submitting it to the Supreme Court registry.

    He affirmed that the petition would be filed before the stipulated deadline issued by the Judiciary, adding that they had a strong case to argue.

    “Being a senior counsel, they asked me to go travel to Nairobi so that I can have a look at the work that the lawyers have compiled.

    “They also called on other senior counsels like Orengo and once we give the green light, then the petition will be submitted in court. I assure you that it will be filed by Monday, August 22,” he added.

    Wako’s assurance came less than 24 hours from the submission deadline with the Court’s stating that it would not receive documents past 2.00 p.m.

    Speaking during a service at JTM Donholm in Nairobi, the former Prime Minister described the legal process as a moment of truth. Drawing parallels between him and the Biblical David, he promised to conquer the milestone ahead.

    “God is talking to David and telling him to pursue them. We shall pursue them conquer them and and rescue all the people,” Odinga stated.

    The Azimio flag-bearer accused the Independent Election and  Boundaries Commission (IEBC) of trying to muzzle the voice of Kenyans who spoke in unison on August 9.

    Quoting Nobel Piece Price Winner, the late Bishop Desmond Tutu, he noted that the truth will be integral in fostering reconciliation in the country.

    “Without truth, there can be no justice, without justice, there can be no peace, and without peace, there will be no reconciliation. We already know the truth ourselves and we are going to show it openly starting tomorrow in court,” he declared.

    According to Article 140 of the Constitution of Kenya (2010), a presidential petition should be filed within a week of the announcement of the outcome of a General Election.

    “A person may file a petition in the Supreme Court to challenge the election of the President-elect within seven days after the date of the declaration of the results of the presidential election,” reads Article 140.
