Court Issues Directive on Susan Kihika’s Father Ksh600M Property Row

  • The High Court sitting in Nakuru has directed that the succession case pitting the family of the late Moi-era politician, Kihika Kimani, be handed over to another Judge.

Kihika Kimani – the father to Nakuru Senator Susan Kihika – left behind a huge estate that has been at the centre of a succession row.

The succession case, which has been in court for more than a decade, will now be handled by Justice Tereseia Matheka, who will take over from Justice Rachael Ng’etich.

Justice Ng’etich declined to recuse herself from the case which she was assigned in 2019 stating that she was competent enough to handle the matter involving widows of the late veteran politician and children.

The Judge has since been compelled to stop any further handling of the matter after being transferred to Kiambu High Court.

While delivering the judgment, Justice Joel Ngugi ordered that the file be handed over to Justice Matheka ahead of the mentioning date set for May 16.

Before the Judge was removed from handling the case, one of the Kihika’s family members had lodged a complaint accusing her of being unfair and unjust.

The Ksh600 million property is under the administration of four widows, Margaret Wambui, the first widow, and her co-wives Alice Mukuhi, Mary Wangari and Miriam Warau.

The former MP also owned over 1,000 acres of land in Njoro, Nakuru. Among the coveted properties is a 50-acre parcel of land in Engashura, Bahati.

Others include vast lands in Rumuruti, Laikipia County estimated to be about 1,000 acres. There are three plots in Naivasha and one in Nairobi valued at over Ksh100 million.

Senator Kihika is believed to have one of the biggest beneficiaries of her late father’s property. According to a handwritten letter, Kimani described his daughter, Susan Kihika, as a good girl and favourite hence bequeathing her a lion’s share of his Ksh600 million estate.

“This is the girl I love most. She did me good in America,” the letter read in part.

Kihika, on the other hand, has remained mum about the issue even as the widows and other children continue to battle for a share of the multimillion estate.
